UNTAMED CYCLING (PTY) LTD
Terms and Conditions, Indemnity and Payments
In regards to the services provided by Untamed Cycling and its owners namely, the cycling tour in which I will partake (“the Tour”), I acknowledge that:
There are inherent risks that are also some of the same elements that contribute to the uniqueness of cycling that can cause loss or damage to my equipment, bodily injury or in the extreme, permanent injury or death. These risks may arise from, inter alia:
Weather conditions may change quickly (for example, rain, hail, storms, snow, lightning strikes)
Cycling takes place in a natural environment where unseen, unmarked and unexpected objects and conditions create risks for example, insect or animal contact, unstable surface conditions, falling rocks and the like.
These are some but not all, of the inherent causes of the risks associated with the type of cycling that I expect to be doing. A complete list of inherent and other risks is not possible and not all risks can be anticipated.
Untamed Cycling, who provide skilled and trained trip co-ordinators so that I can participate in the Tour, will endeavour to make the trip as safe as possible, however, I acknowledge that I am responsible for all risks relating to the Tour.
I therefore agree:
to assume and accept full responsibility for all risks identified herein and those risks not specifically identified and associated with the Tour and
that my participation is purely voluntary with full knowledge of the inherent risks.
I hereby indemnify and hold harmless Untamed Cycling for any death or injury which may be suffered by me and/or any material damage, including any damage to any of my bicycles and/or equipment, loss of any of my equipment, illness I may suffer and any damages whatsoever as a result of my participation in the Tour
I hereby agree to indemnify and hold harmless Untamed Cycling from and responsibility for damage, loss of equipment or personal injury, illness or death that might result from participating in activities with Untamed Cycling.
I hereby confirm having been advised by Untamed Cycling that in order to attempt to mitigate any damage I may suffer my responsibilities are, inter alia:
- that I ensure that my bicycle is in good order and condition for cycling on the Tour
- that I wear a suitable helmet and cycling attire at all times when riding on the Tour
- that I obtain suitable insurance with respect of personal property in the event of loss suffered
- that I ensure that I am in possession of suitable Medical Insurance during the course of the Tour
- that I will ride with the group and follow the route provided by Untamed Cycling and comply with Tour operator’s directions
